1) Scope & Updates
These Terms govern sales of sealed baseball card hobby boxes and sealed cases (the “Products”). We may update Terms at any time; continued use after changes means you accept the updated Terms.

2) Eligibility & Intended Use

You must be 18+ (or the age of majority in your state) to purchase.
Products are sold for personal collecting/entertainment only. We do not promise investment returns, grading outcomes, or specific card pulls.

3) Product Condition, Contents & Authenticity

Items are factory-sealed from authorized distributors/manufacturers unless clearly stated otherwise.
No guarantees of hits, player selection, parallels, print runs, autographs, or redemptions. Any stated “odds” or “checklists” are manufacturer disclosures and not guarantees by Rip Gems.
Once a seal is broken, we cannot verify contents and assume no responsibility for collation, manufacturer defects, or card condition. For sealed-product defects, contact the manufacturer.
Images and descriptions are for identification; minor packaging variations may occur.

4) Pricing, Availability & Errors

Prices are in USD and may change without notice.
Inventory is limited; we reserve the right to limit/cancel quantities. If an item is unavailable after purchase, you’ll receive a refund.
We may cancel orders due to typographical, inventory, or pricing errors.

5) Payments & Fraud Prevention

We accept the payment methods shown at checkout. Orders are charged at purchase.
We may refuse/cancel orders for suspected fraud, chargeback risk, or misuse.
By paying, you represent you’re authorized to use the payment method.

6) Preorders & Allocations

Estimated release dates are set by the manufacturer and may change.
If our distributor reduces allocations or a product is canceled/delayed, we may cancel and refund (or offer store credit, at our option).
Preorder cancellations by you may be subject to a fee or may be non-cancelable (as stated on the product page).

7) Shipping, Risk of Loss & Delivery

Processing time is typically 1-2 business days (excludes weekends/holidays).
Carrier options, costs, and estimated transit times are shown at checkout; transit times are not guaranteed.
Risk of loss and title pass to you when the carrier takes possession (when we deliver to the carrier).
Address accuracy: You’re responsible for entering a correct shipping address. We aren’t responsible for misdelivery due to address errors.
Porch piracy & theft: Once tracking shows “Delivered,” claims must be filed with the carrier or local authorities.
Signature/Insurance: We may require signature confirmation for orders ≥ $800. You may be offered shipping insurance at checkout; if you decline, you accept the risk of carrier loss/damage.
Inspection on delivery: Report shipping damage or missing items to us within 48 hours of delivery with photos of the box, shipping label, packing materials, and the sealed product. We’ll help you file a carrier claim; refunds/replacements aren’t guaranteed and depend on the carrier/insurer.

9) Returns, Exchanges & Cancellations

All sales are final on sealed hobby boxes and sealed cases. No returns or exchanges.
Order cancellation requests before shipment may be considered at our discretion; once a label or tracking is created, the order cannot be canceled.
Wrong item shipped: Contact us within 48 hours (unopened, with photos). We’ll provide next steps.

10) Redemptions, Expirations & Grading

Manufacturer redemptions may be limited or expire; these are the manufacturer’s responsibility.
We do not warrant PSA/BGS/CGC or any third-party grading outcomes, subgrades, turnaround times, or market values.

11) Promotions, Giveaways & Breaks

Promotions and giveaways are void where prohibited and are subject to posted rules.
For breaks, participants agree to the stated randomization/team allocation method. We are not responsible for manufacturer defects or contents.

12) Taxes & Resale

We collect sales tax where required.
If you purchase for resale, you must provide a valid resale certificate in advance; otherwise tax may be collected.

13) Limited Warranty & Disclaimers

EXCEPT AS EXPRESSLY STATED, PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT CONTENTS OF SEALED PRODUCTS, MANUFACTURER QUALITY CONTROL, ODDS, PRINTING/COLLATION, OR REDEMPTION AVAILABILITY.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RIP GEMS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT AT ISSUE.

15) Dispute Resolution; Binding Arbitration; Class-Action Waiver

Informal Resolution: Before filing a claim, you agree to email us and attempt to resolve any dispute in good faith within 30 days.
Binding Arbitration: Except for (i) small-claims court or (ii) injunctive relief for IP misuse, any dispute arising from these Terms or your purchase will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
No Class Actions: You and Rip Gems waive any right to participate in a class or representative action or class arbitration.
Venue & Law: The arbitration seat and exclusive venue for any court proceedings to enforce arbitration or enter judgment shall be Baltimore County, Maryland, under Maryland law and applicable federal law (including the FAA).
Opt-Out: You may opt out of this arbitration agreement by sending written notice to the address below within 30 days of your first purchase. Your opt-out must include your name, address, email, and a statement that you opt out of arbitration.

16) Intellectual Property & No Affiliation

All site content (logos, graphics, text) is owned by Rip Gems or our licensors.
No affiliation or endorsement is implied with MLB, MLB teams (including the Baltimore Orioles), the NFL/Baltimore Ravens, or any trading card manufacturer or grader unless expressly stated.

17) Force Majeure
We aren’t liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, labor disputes, shortages, carrier disruptions, cyber incidents, acts of government).

18) Privacy & Electronic Communications

Your use of the site is also subject to our Privacy Policy
You consent to receive transactional communications electronically (email/SMS) related to your order.

19) Severability, Assignment & Entire Agreement
If any provision is unenforceable, the remainder remains in effect. You may not assign your rights without our consent. These Terms (plus posted product terms and your order confirmation) are the entire agreement regarding your purchase.
